Valid at every location where these services are provided by the operator – primarily rented massage studios and at the customer's own premises.

1. General provisions

1.1. These general terms and conditions govern the legal obligations between the provider of massage and consultation services, Ing. Jiří Mošna, MBA (hereafter the „operator“), Company ID 06353983, and the buyer of the services provided (hereafter the „buyer“), a visitor to the studio (hereafter the „visitor“), and the user of the services provided (hereafter the „customer“ or „client“).

1.2. The operator provides massage and consultation services under a valid trade license and documents certifying professional competence for the activities performed.

1.3. By purchasing a gift voucher, gift certificate, or by booking a specific service by phone, the buyer, visitor, and customer each express their agreement with the operator's general terms and conditions.

1.4. Every provision of massage or consultation services takes place through an individual, time- and topic-bounded session (hereafter a „session“).

2. Booking and provision of services

2.1. Session date and time
A session date and time must be agreed and booked in advance by phone. Agreeing on a specific place, date, and time creates a binding booking of services. The operator reserves the relevant time of the massage therapist/consultant and the space for the session for the agreed appointment, and prepares the space for the service.

2.2. Rescheduling and cancelling a booking
If, for serious reasons, the customer cannot attend the agreed session, they must inform the operator in advance by phone, no later than 24 hours before the agreed start of the session. Notice of rescheduling or cancellation given later, between 24 hours and 2 hours before the agreed session time, carries a cancellation fee of CZK 500. Cancelling or rescheduling less than 2 hours before the agreed session is treated as a customer no-show.

2.3. Early arrival
The session premises are not accessible at any time, and there is no waiting room. Out of consideration for other visitors and customers, arrival is possible no earlier than 5 minutes before the agreed time.

2.4. Late arrival
If a customer arrives after the agreed time, the service will be provided for a shortened duration so that it ends at the originally scheduled time. The resulting session length may not be less than 90 minutes. If it would be shorter, the customer must extend it, if the operating and capacity conditions of the location allow, or the delay is treated as a customer no-show.

2.5. Customer no-show
In the event of absence (see 2.2.) or a late arrival (see 2.4.), the customer and buyer will jointly be required to pay the full value of the reserved time for the booked session, or this amount will be deducted directly from the value of a certificate or voucher.

2.6. Refusal to provide a session, or limiting the scope of services, without any right to a refund of the price paid, and with possible application of the rules under points 2.2–2.5. Provision of services or arranging a session may be refused in these cases:

  • the customer arrives with evident symptoms of an infectious illness
  • the customer arrives intoxicated or under the influence of drugs
  • the customer arrives with health problems that do not allow the service to be provided safely
  • the customer arrives in an unacceptable state of hygiene and refuses to remedy the situation
  • during booking, the customer's words or behavior indicate that they do not appreciate the value, positive benefits, and purpose of the services provided

2.7. Early termination of services provided, or limiting the scope of services, without any right to a refund of the price paid, and with possible application of the rules under points 2.2–2.5. Provision of services may be terminated early if, during the session:

  • the customer shows evident symptoms of an infectious illness
  • the customer shows evident symptoms of intoxication or drug use
  • the customer shows evident symptoms of health problems that do not allow the service to be provided safely, or
  • despite repeated requests, the customer's words or behavior indicate that they do not appreciate the value, positive benefits, and purpose of the services provided

2.8. Companions and accessibility
In justified cases, and by prior agreement with the operator, a customer may be accompanied by a maximum of one adult visitor. The premises used for providing services are not generally equipped for the presence of children, prams, dogs, wheelchair users, or people with other limited mobility or orientation.

2.9. Departure of the customer
Out of consideration for other visitors and customers, every customer is expected to leave without undue delay after the session ends, or according to the operator's instructions.

2.10. Personal belongings and valuables
For security reasons, the session location is protected from entry by third parties by locking the entrance door for the whole duration of the session. However, the operator is not liable for any loss of the client's belongings before, during, or after the session. Customers and visitors may keep their valuables in sight for the whole duration of the session.

2.11. Informed consent of the customer, visitor, and buyer
Before their first session, the customer is briefed on health risks, indications, and contraindications. They are further informed about how the services are provided, the rights and obligations of the operator and the customer, and responsibility for the content of the session. Together with any accompanying visitor, they are informed which personal, confidential, and sensitive data about them is kept for the operator's internal use. None of the above data is passed to third parties unless ordered by a court or another body authorized by law, and it is not used for any purpose other than:

  • defending the operator's legitimate interests in the event of complaints by a customer, buyer, or visitor,
  • successfully running sessions and tracking the progress of services provided to date for an individual customer, for the purposes of further providing services,

Personal data such as first name, last name, phone number, and email, or contacts on social networks, is used to identify past customers or buyers and to communicate with them. If a customer or visitor decides to go ahead with a session, they thereby clearly and freely give their informed consent. More detail is provided on the GDPR page.

2.12. Massage price list
The massage price list can be viewed on the tantra-shibari.cz website.

3. Complaints about services

When making a complaint about services provided, the customer must promptly and credibly demonstrate that the subject of the complaint relates to a specific failing by the operator. Complaints are submitted in writing to the operator's address, or electronically to the operator's email address. In the case of an unfounded complaint, the cost of handling it will be recovered from the customer.

4. Gift voucher

4.1. A gift voucher can be purchased in person from the provider, or by email – it will be prepared on request.

4.2. Using a gift voucher
A gift voucher can be used to pay for any Shibari/tantra/tantra-Shibari session. For a gift voucher with a stated nominal value, the exact type and scope of service can be agreed when booking the visit, or before the session. Descriptions of the individual session types can be found on the tantra-shibari.cz website. Payment by gift voucher must be declared before the massage begins, so its validity can be checked.

4.3. Value of a gift voucher
Gift vouchers are issued either with a stated nominal value, or for a specific type of session with a stated maximum duration. Any unused value of a gift voucher cannot be exchanged back for cash.

4.4. Validity of a gift voucher
A gift voucher is valid as long as its value has not been used up and its validity period has not expired. A gift voucher can also be used for partial payment, with the remainder paid in cash.

4.5. Validity period
A gift voucher's validity period is six months from the date of sale; the validity is stated on the voucher itself. The service under the gift voucher, or its last remaining part, must be used before the end of the validity period. The validity period cannot be extended. The date of use is agreed with the operator and depends on the available capacity of the massage studios used and the operator's own schedule – for this reason it is essential to arrange a specific date for using the service no later than one month before the voucher's validity period ends.

5. Final provisions

5.1. Workplace safety and risk prevention
By entering the premises, the customer agrees to their obligation to observe the operator's workplace safety and risk-prevention rules, and the obligation to follow the operator's safety instructions.

5.2. Validity and effect
These general terms and conditions take effect as of 1 September 2017.
